"Geek for a Day" Contest -- Official Rules
1. NO PURCHASE IS NECESSARY.
2. SPONSOR. This contest is sponsored by Brian Livingston ("Sponsor"), 300 Queen Anne Ave. N. #456, Seattle, WA 98109-4599.
3. ELIGIBILITY. The contest is open only to legal U.S. residents 18 years of age or over as of the date of entry. Employees or agents of Sponsor, his affiliates, advertising and promotional agencies, and the employees, officers, directors, and agents of any of the above organizations, and the members of the immediate family or those living in the same households (whether related or not) of such individuals are not eligible.
4. HOW TO ENTER. No purchase is necessary. A purchase will not increase your chances of winning. All entries must be received by 11:59 p.m. PST on March 31, 2001. To enter, simply visit http://www.iwsubscribe.com/newsletters and select a free subscription to the "E-Business Secrets" newsletter. All weekly issues published in March 2001 will include one-click instructions to enter the contest. Entrants must have Internet access as of the date the Contest begins. No responsibility is assumed for late, lost, or misdirected entries or for telecommunications system, computer software, or hardware errors or data loss. Limit of one entry per person.
5. PRIZES. Two (2) prizes will be awarded. Each prize will consist of a personal visit from Sponsor, who will travel at his own expense to the winner's residence or workplace (at option of winner), and spend up to six (6) hours advising the winner on resolving problems with the Microsoft Windows operating system. Approximate retail value of prizes is $4,000. Sponsor has sole discretion to choose date(s) for visits. If winner is not available on the chosen date, the prize may be forfeited. No substitution or cash equivalent of prize is permitted. Sponsor reserves the right to award prize of equal or greater value if advertised prize is not available. All taxes on prizes are the sole responsibility of the winners. "Microsoft" and "Windows" are registered trademarks of Microsoft Corporation.
6. SELECTION OF WINNERS. Winners will be selected in random drawings from among all eligible entries received. The odds of winning depend upon the number of eligible entries received. One winner will be chosen from among all entrants who subscribed to the newsletter prior to March 1, 2001, and one winner will be chosen from among all entrants who subcribed to the newsletter on or after March 1, 2001, and prior to the conclusion of the Contest. The winners will be chosen or or about April 2, 2001, and notified by e-mail. Winners may be required to sign and return an Affidavit of Eligibility and a Liability/Publicity Release within fifteen (15) days of notification attempt, or an alternate winner may be selected. The names of the winners will be announced at the conclusion of the contest.
7. GENERAL CONDITIONS. Void outside of the United States and where prohibited by law. The contest is subject to all federal, state, and local laws. By entering, participants agree to be bound by these Official Rules and the decisions of the Sponsor on all matters relating to this contest. By accepting a prize, the winners grants to Sponsor the right to use their name, likeness, and biographical information for any lawful purpose, including on the BrianLivingston.com website, without further permission or compensation, except where prohibited by law.
By entering the contest, winners agree to release Sponsor and his affiliates and his advertising/promotional agencies from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to person or property that may be sustained in connection with the receipt, ownership, or use of a prize or with participation in this contest. Entrant specifically agrees that Sponsor, his affiliates, advertising and promotional agencies, and the employees, officers, directors, and agents of any of the above organizations shall not be liable for any injury or damage to any person's computer hardware, software, or peripherals sustained during the course of the visit by Sponsor or any injury or damage to such equipment utilized in participating in the contest. Sponsor and his agencies are not responsible for technical, hardware, software, or telephone malfunctions of any kind, for lost or unavailable network connections, or for any equipment or programming-associated connections, or for failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications with or utilized in this contest that may limit the ability to play or participate, or for any human error that may occur in the processing of the entries in this contest. If for any reason (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this contest), the contest is not capable of being conducted as described in these Official Rules, Sponsor shall have the right, in his sole discretion, to cancel, terminate, modify, or suspend the contest. All decisions by the Sponsor with respect to the operation of the contest are final.
Sponsor reserves the right to disqualify any individual he finds to be acting in violation of these Official Rules or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR AND HIS AGENTS RESERVE THE RIGHT TO PROSECUTE SUCH PERSON AND/OR SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULL EXTENT PERMITTED BY LAW.
8. WINNER'S LIST. The names of the winners will be posted on the homepage of Sponsor, located at http://BrianLivingston.com and is also available to individuals sending a self-addressed stamped envelope to Sponsor at the address below after April 2, 2001.
